В статье рассматриваются проблемы, связанные с использованием результатов оперативно-режимных мероприятий при проведении допроса в ходе расследования преступлений, совершаемых осужденными в исправительных учреждениях, и влиянием этих данных на процесс расследования. Проанализированы точки зрения различных авторов относительно особенностей проведения рассматриваемого следственного действия в условиях исправительного учреждения. Рассмотрены причины и условия, влияющие на качественное проведение допроса и возможность получения значимой информации. Обращено внимание на вопросы предварительной подготовки к проведению допроса и организации надлежащего взаимодействия следователя с оперативными сотрудниками исправительного учреждения.
The article discusses the problems associated with the use of the results of operational measures during interrogation during the investigation of crimes committed by convicts in correctional institutions, and the impact of these data on the investigation process. The points of view of various authors regarding the specifics of the investigative action in question in a correctional facility are analyzed. The reasons and conditions affecting the quality of the interrogation and the possibility of obtaining meaningful information are considered. The author draws attention to the issues of preliminary preparation for the interrogation and the organization of proper interaction between the investigator and the operational staff of the correctional institution.
