Приводятся результаты системного анализа требований нормативных правовых актов и материалов судебной практики в части определения роли особых условий государственных контрактов, заключаемых с субъектами естественных монополий на поставку газа, электрической и тепловой энергии в учреждения и органы уголовно-исполнительной системы, составляющих особенности правового регулирования обеспечения устойчивого газо- и энергоснабжения финансируемых за счет средств федерального бюджета организаций, обеспечивающих безопасность государства; рассматриваются вопросы правомерности использования контрагентами контрактов положений п. 2 ст. 425 Гражданского кодекса Российской Федерации к обязательственным отношениям, а также правомерности действий поставщика по ограничению или прекращению поставки воды, газа, электроэнергии в случае наличия задолженности у учреждений и органов уголовно-исполнительной системы по их оплате.
Results of the system analysis of requirements of regulations and materials of court practice regarding the determiting the role of special conditions of the government contracts concluded with subjects of natural monopolies for supply of gas, electric and thermal energy to institutions and bodies of the penal system that form special features of legal regulation of providing steady gas and power supply of the organizations financed at the cost of the means of the federal budget ensuring safety of the state are given; questions of legitimacy of the use by contractors of provisions of item 2 of Art. 425 of the Civil code of the Russian Federation to the obligations relations and also legitimacy of actions of the supplier for restriction or the termination of supply of water, gas, the electric power in case of presence of debt at institutions and bodies of the penal system on their payment are considered.
