The article examines the specifics of the construction of Article 191 of the Criminal Code of the Russian Federation in terms of establishing the signs of the subject of the crime. The problem of terminological inconsistency of this criminal law norm with the norms of special legislation in the sphere of turnover of amber, jade or other semiprecious stones, precious metals or precious stones is revealed. Measures have been proposed to improve Article 191 of the Criminal Code of the Russian Federation in terms of clarifying the subject of criminal encroachment. In addition, the rules for the qualification of illicit trafficking in faceted precious stones and artificial stones disguised as precious stones are proposed, the legal assessment of which causes difficulties in law enforcement practice and discussion in the scientific literature.
