In criminal law science, the problem of formulating the concept of guilt, covering the signs of intent and negligence, has not yet been resolved. The issue of determining the legal nature of criminal negligence in relation to the identification of a person's mental attitude to the committed act is acute. The purpose of the study is to modernize the forms of guilt and establish their common features. The article suggests a change in the wording of the forms of guilt. New designs have been tested through scientific modeling. The concept is based on the views of V. V. Luneev, B. S. Volkov, V. G. Ma- kashvili, and I. Lekshasa, L. S. Rubinstein, P. Ya. Galperin, and others. The essence of the concept is to recognize the facts of a person's awareness of the public danger of a crime and the subject's lack of willingness to commit an act in case of negligence. Such a design will make it possible to successfully distinguish in practice between negligence, frivolity and indirect intent and, through an intellectual element, reveals the presence of a person's mental attitude to crime, suggests stubbornness, and weakens the existing discussion.
