Abstract (English):
Is devoted to the comparative characteristic of the criminal procedure codes of the Russian Federation and the Republic of Kazakhstan concerning regulation of the initiation of criminal proceedings in Russia and the beginning of the investigation in Kazakhstan. The relevance of the article is that the Russian legislator has not decided the future of the institution of the criminal case: keep it in the code or cancel, as is done in Kazakhstan. In this regard shows the differences and similarities in the regulation of this institution in the legislation of the two countries.
