Both external, and internal factors can influence normal functioning of institutions and bodies of a penal system. The reasons and reasons for emergence of the situations capable to affect negatively safety (mode) in correctional facilities, can be provoked as serious shortcomings of activity of places of detention, and aggravation of a social, criminogenic situation around their arrangement, emergence of emergency situations of natural and technogenic character.The solution of problems of safety (mode) in the conditions of a complication of an operational situation in correctional facilities and also creation of system of their prevention is possible only by complex definition of theoretical, legal, organizational, tactical bases of activities of subjects for her providing on a scientific basis.On the basis of conceptual regulations on a legal regime of the special conditions formulated as a result of the carried-out analysis the following conclusion is drawn: it is necessary to understand set of the factors accompanying holding the actions directed to prevention or elimination of emergency situations of natural and technogenic character, force majeure and also maintenance of the mode of counter-terrorist operation and particular legal regimes of extraordinary and military provisions as the mode of special conditions in correctional facilities provided by the article 85 PEC of the Russian Federation.
