The author analyzes a question of realization in practical activities of correctional facilities of requirements of the criminal and executive legislation establishing norms of living space counting on one convict (item 1 of Art. 99 of the Penal Code of the Russian Federation). The problematical character of a question of reference of correctional facilities to residences is emphasized. The national criminal and executive legislation and the European penitentiary rules in the considered sphere are compared. The measures directed to realization of the right of the convict to imprisonment on providing with living space in the sizes established by the law are formulated.
