LIST OF SOCIALLY SIGNIFICANT DISEASES, HAVING CRIMINAL LEGAL SIGNIFICANCE: THE AUTHOR'S VIEW

Abstract (English):
The article notes that in the modern world, one of the main problems of the state remains the preservation of public health. The subject of particular concern is diseases, the spread of which leads to high mortality or primary disability. The list of such diseases was approved by the Decree of the Government of the Russian Federation No. 715 of December 1, 2004. One of the main means of countering the spread of socially significant diseases are criminal law and penal enforcement means. At the present stage of the development of punitive legislation, not all categories of persons with socially significant diseases may be required to undergo treatment for these diseases. It is also impossible to apply the duty to a part of socially significant diseases. However, the presence of a socially significant disease in a person brought to criminal responsibility does not always have criminal legal significance. The purpose of the work is to determine the list of socially significant diseases, the presence of which in a person brought to criminal responsibility has criminal legal significance. As a result, it is concluded that the category of socially significant diseases includes: tuberculosis; sexually transmitted infections; disease caused by the human immunodeficiency virus; hepatitis B and C; mental disorders and behavioral disorders.
