TERMINATION OF A CRIMINAL CASE IN A SPECIAL ORDER

Abstract (English):
The article examines the possibility of a court making a procedural decision to terminate a criminal case on a non-rehabilitating basis within the framework of a special procedure for judicial proceedings, with the consent of the accused to the charges brought against him. The legal positions of the Plenum of the Supreme Court of the Russian Federation on this issue are analyzed. The proposals for changing the name of the petition of the accused in Chapter 40 of the Code of Criminal Procedure of the Russian Federation, which initiates the application of a special procedure by the court, and the regulation of the procedure for making final court decisions are substantiated.
