Paradoxes of legislation and their impact on the level of repeated criminality of convicts to correctional labor

Abstract (English):
The article analyzes one of the main evaluation indicators of the activities of the penal enforcement inspections of the territorial bodies of the Federal Penitentiary Service. On the basis of statistical data, the level of repeated criminality of persons registered with the criminal executive inspections over the past five years is considered. A significant difference in the number of persons who committed repeated crimes after registration and in the reporting period was revealed, indicating a certain level of latency of this indicator. The article substantiates the direct influence on the level of repeated criminality of persons in this category of factors such as release from prison in accordance with Article 80 of the Criminal Code of the Russian Federation, conviction for serious and especially serious crimes, as well as the presence of previous and current convictions. There is a decrease in the number of convicts who are sentenced to imprisonment for committing a repeat crime. The imperfection of legal regulation in the issue of sentencing for the commission of a repeat crime has been revealed, especially for convicts who have been assigned correctional labor as a milder type of punishment. In order to reduce the level of repeat criminality and achieve the goals of punishment, it is proposed to make amendments and additions to the current criminal legislation.
